Terms of Service for Purchasing Rachel Scott, LLC Educational Products

  • The Consultant retains the copyright for all materials (the “Intellectual Property”) provided under this Agreement,
    • The Client is granted a non-exclusive, worldwide, lifetime-use license of this Intellectual Property.
    • Title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with the Consultant.
    • Even if the materials are modified or translated, they may not be sold by anyone other than the Consultant.
  • The license is for the Client only. It is non-transferable and non-shareable, unless with the written permission of the Consultant.
    • The Client is responsible for ensuring that any individuals who are given access to the materials by the Client or by the Client’s request are aware of appropriate usage and treat the material in accordance with this copyright agreement.
    • Sharing the student handouts with your trainees is accepted usage and does not need to be communicated to the Consultant.
  • The license is for the duration of the Client’s lifetime (or business).
  • The Client may edit the material for their own use.
  • The Client may not resell or distribute any of the Consultant’s material for any reason outside of its intended educational purpose, which is for the Client to run a 200 hour yoga teacher training or yoga education program.
    • The Consultant confirms that she owns the copyright to this material and has obtained the necessary permissions for the use of media that is included in the student manual and trainer presentations.
    • The Client understands that they may not remove attributions to the graphics and media included in the training, as these attributions are part of the necessary permissions for usage.
    • The Client understands that they are solely responsible for ensuring they have obtained the appropriate copyright for any changes to the graphics/media.

Failure to comply with the Terms of Service is a breach of contract and may result in legal action.

Hold Harmless

Through my purchase, I agree that I am solely responsible for the use and instruction of any and all products and services received or purchased from Rachel Scott, LLC and I agree to indemnify and save harmless Rachel Scott and Rachel Scott, LLC from and against all liability claims and demands on account of injury to persons including resulting from the use of these materials.

Privacy Policy

Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.

Information you voluntarily provide to us

When you sign up for the newsletter, purchase a product, write a comment, send us a direct email, post on our blog, or communicate with us in any way, you are voluntarily giving us information that we collect. That information may include your name, physical address, email address, IP address, phone number, credit card information, as well as details including location and other demographic information.

Blog. We have public blogs on our websites. Any information you include in a comment on our blog may be read, collected, and used by anyone. If your Personal Information appears on our blogs and you want it removed, contact us by email. If we are unable to remove your information, we will tell you why.

Social media platforms and widgets. Our Websites include social media features, such as the Facebook Like button. These features may collect information about your IP address and which page you are visiting on our Website, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. We also maintain presences on social media platforms including Facebook, Twitter, and Instagram. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

Links to third-party websites. Our Websites include links to other websites, whose privacy practices may be different from ours. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.

Information we collect automatically

When you use the Services or browse one of our Websites, we may collect information about your visit to our Websites, your usage of the Services, and your web browsing. That information may include your IP address, your operating system, your browser ID, your browsing activity, your location, and other information about how you interacted with our Websites or other websites. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies. Facebook pixels and Google Analytics are used to track visitor usage and provide feedback about marketing strategies.

Third party services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

Certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our course website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Woo Commerce. When you make a purchase through this site, we use a third party company called Woo Commerce to collect and manage fees. Woo Commerce uses a third party processor such as Stripe or Paypal. As a part of their process, we obtain personal information you give us such as:

  • Name
  • Address
  • E-mail address
  • Phone number
  • Credit/Debit Card Information

We may use this information to send you your product, communicate about product usage, send you bills, communicate about your account and collect payment.

BirdSend & Thinkific. If you sign up for a course or purchase a product, we may send you emails about our site and related products, course(s), registration, course content, your course progress or other updates. We may also use your email to inform you about changes to the course, updates, survey you about your usage, or collect your opinion.

Your information may be added to our Third Party Newsletter service (BirdSend) to facilitate communication.

Some courses are hosted through Thinkific. In this event, your name, email, country of residence (and province if you are in Canada), may be shared with Thinkific for the purpose of course communication and management. While you will need to register separately for Thinkific and may view the Privacy Policy there, here are their Terms of Service:

Newsletter Sign Up

Your information may be added to our Third Party Newsletter service (BirdSend) to facilitate communication.

If you opt in for our newsletter, we may send you emails about our site and related products, course(s), registration, course content, and other updates. We may also use your email to inform you about changes to services, products, courses,  and survey you about your usage, or collect your opinion.

From time to time, we run product giveaways and promotions where you may voluntarily provide further personal information to participate (including your address). By providing us with this information, you are giving us consent to share your information with this third party vendor. Before submitting your information for the giveaway, you may wish to review the privacy policy of the vendor.

How do I withdraw my consent?

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at info@rachelyoga.com. To unsubscribe from a Mailchimp or Keap newsletter, click the unsubscribe button at the bottom of your page.

Note: unsubscribing from a newsletter service that is part of an ongoing course may result in you missing vital information and course updates.
